MEMBERSHIP AGREEMENT
ARTICLE 1 - PARTIES
1.1. TATİLCİNİZ TURİZM TİCARET LİMİTED ŞİRKETİ ("Tatilciniz"), registered at Mecidiyeköy Mahallesi Musa Dayı Sokak Can İş Merkezi No:4B Şişli/Istanbul, which operates the "tatilciniz.com.tr" website
1.2. The internet user who is a member of the "tatilciniz.com.tr" website ("Member")
ARTICLE 2 - SUBJECT OF THE AGREEMENT
The subject of this Agreement is to determine the conditions under which the Member may benefit from the website tatilciniz.com.tr, owned by TATİLCİNİZ Turizm Ticaret Limited Şirketi.
ARTICLE 3 - RIGHTS AND OBLIGATIONS OF THE PARTIES
3.1. The Member declares and undertakes that the personal and other information provided while becoming a member of the "tatilciniz.com.tr" website is accurate before the law, and that they will compensate Tatilciniz fully and immediately for all damages Tatilciniz may suffer due to the inaccuracy of this information.
3.2. The Member may not provide the password given to them by Tatilciniz to any other person or organization; the right to use the said password belongs exclusively to the Member. Therefore, all liability that may arise for this reason, as well as Tatilciniz's right to claim any compensation and other demands arising from such unauthorized use against all claims and demands that may be asserted against Tatilciniz by third parties or authorized authorities, are reserved.
3.3. The Member accepts and undertakes to comply with and not violate the provisions of applicable legislation while using the "tatilciniz.com.tr" website. Otherwise, all legal and criminal liabilities that may arise shall be borne entirely and exclusively by the Member.
3.4. The Member may not use the "tatilciniz.com.tr" website in any way that disrupts public order, violates general morality, disturbs or harasses others, for an unlawful purpose, or in a manner that infringes the intellectual and copyright rights of others. In addition, the Member may not engage in activities or transactions (such as spam, viruses, Trojan horses, etc.) that prevent or make it difficult for others to use the services.
3.5. The ideas and opinions declared, written or expressed by Members on the "tatilciniz.com.tr" website are entirely the Members' own personal opinions and bind their authors. These opinions and ideas have no relation or connection with Tatilciniz. Tatilciniz shall have no liability for any damages that third parties may suffer due to the ideas and opinions declared by the Member, or for any damages that the Member may suffer due to the ideas and opinions declared by third parties
whatsoever.
3.6. Tatilciniz shall not be liable for the reading of Member data by unauthorized persons or for any damage that may occur to the Member's software and data. The Member has accepted in advance that they will not claim compensation from Tatilciniz for any damage they may suffer due to use of the "tatilciniz.com.tr" website.
3.7. The Member accepts not to access or use the software and data of other internet users without authorization. Otherwise, all legal and criminal liability arising therefrom shall belong entirely to the Member.
3.8. A Member who violates one or more of the provisions set forth in this membership agreement shall be personally liable, both criminally and legally, for such violation and shall hold Tatilciniz harmless from the legal and criminal consequences of these violations. Furthermore, if, due to this violation, the matter is brought into the legal sphere, Tatilciniz reserves the right to claim compensation from the Member for non-compliance with the membership agreement.
3.9. Tatilciniz always has the right, unilaterally and whenever necessary, to delete the Member's membership and to delete files, documents and information belonging to the customer. The Member accepts this action in advance. In this case, Tatilciniz shall have no liability whatsoever.
3.10. The software and design of the "tatilciniz.com.tr" website are the property of TATİLCİNİZ Turizm Ticaret Limited Şirketi, and the copyrights and/or other intellectual property rights relating thereto are protected by the relevant laws; they may not be used, acquired or modified by the Member without authorization. Other companies and products mentioned on this website are the trademarks of their respective owners and are also protected under intellectual property rights.
3.11. Tatilciniz may collect certain information for the improvement and development of the "tatilciniz.com.tr" website and/or within the framework of applicable legislation, such as the name and Internet Protocol (IP) address of the Internet service provider used to access the site, the date and time of access to the Site, the pages accessed while visiting the site, and the Internet address of the website that enabled direct connection to the site.
3.12. Tatilciniz may use Members' personal information in activities aimed at their special preferences and areas of interest in order to provide better service to its users, improve its products and services, and facilitate use of the site. Tatilciniz reserves the right to keep records of the Member's activities on the "tatilciniz.com.tr" website.
3.13. Tatilciniz may disclose the Member's personal information when legally required to do so;
3.13.1. to act in compliance with legal requirements or comply with legal proceedings served on Tatilciniz;
3.13.2. (b) may disclose it where it determines in good faith that this is necessary to protect and defend the rights and property of Tatilciniz and the "tatilciniz.com.tr" website family.
3.14. Measures have been taken within the available means to ensure that the "tatilciniz.com.tr" website is free of viruses and similar malicious software. Nevertheless, to ensure ultimate security, the user must obtain their own virus protection system and provide the necessary protection. In this context, by accessing the "tatilciniz.com.tr" website, the Member shall be deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and for the direct or indirect consequences thereof.
3.15. Tatilciniz reserves the right to change the content of the site at any time, modify or terminate any service provided to users, or delete user information and data registered on the "tatilciniz.com.tr" website.
3.16. Tatilciniz may change, update or cancel the terms of the membership agreement at any time, in any manner or form, without the need for prior notice and/or warning. Each provision that is changed, updated or repealed shall take effect for all Members as of the date of publication.
3.17. The Parties accept and declare that all computer records belonging to Tatilciniz shall be taken as the sole and exclusive evidence in accordance with Articles 187, 188 and 189 of the HMK, and that such records constitute an evidentiary agreement.
3.18. Under this membership agreement, Tatilciniz is authorized to send informational emails to the email addresses and informational SMS messages to the mobile phone numbers registered for its Members; by approving this membership agreement, the Member shall be deemed to have accepted the sending of informational emails to their email address and informational SMS messages to their mobile phone. If the Member wishes to stop receiving emails and/or SMS messages, they may cancel the sending of emails and/or SMS messages by submitting a written request to the address specified in the contact information.
ARTICLE 4 - TERMINATION OF THE AGREEMENT
4.1. This agreement shall remain in force until the Member cancels their membership or their membership is canceled by Tatilciniz. If the Member violates any provision of the membership agreement, Tatilciniz may cancel the Member's membership and terminate the agreement unilaterally.
ARTICLE 5 - DISPUTE RESOLUTION
5.1. The Courts and Enforcement Offices of Istanbul shall have jurisdiction over disputes relating to this agreement.
ARTICLE 6 - EFFECTIVENESS
6.1. The Member's registration of membership means that the Member has read and accepted all the provisions contained in the membership agreement. This Agreement was concluded and entered into force mutually when the Member became a member.
